US Court Mandates Freedom of Kilmar Abrego Garcia from Immigration Custody
A federal judge has ordered the prompt discharge of Kilmar Abrego Garcia from detention by ICE, concluding his continued detainment is without legal authority.
"Since Abrego Garcia's release after erroneous imprisonment in El Salvador, he has been re-detained, again without lawful authority," the judge wrote in her ruling.
The case stems from a erroneous deportation to El Salvador earlier this year, which US authorities later admitted was an mistake. Following his repatriation to the United States to face human smuggling allegations, he was held in federal detention.
In her order, the court noted that the authorities does not have a current removal order, which effectively blocks them from deporting Mr. Abrego Garcia "at this juncture."
Background of the Legal Challenge
The court challenge center on disputed claims. Whereas the Trump administration argues that Abrego Garcia is a member of the MS-13 gang, he vehemently disputes this allegation.
He has also pleaded not guilty to the smuggling counts, which are part of a ongoing criminal case in Tennessee.
Conditions of Release
The court, who was hearing his petition to removal in a federal court, determined that he must now comply with the terms of his bond from custody in Tennessee. This order shifts his supervision to the jurisdiction handling his criminal case.
This ruling marks a notable development in a complicated immigration case involving allegations of mistaken imprisonment and disputed criminal associations.
